you most certain can. i’m not sure who told you that, but it would appear that they have not read the ebay listing policy or perhaps are misinterpreting it. in the video game category you can not list a pirated/replica item that violates someones copyright. as long as the FB+ is blank and described as being a developers tool that allows the execution of homebrew software on actual hardware, you are not violating any rules. i recall something in the policy about devices that circumvent anti-piracy measures, but i am unable to find that now. with that said, this isn’t like the new generation of ds flash kits that require a portion of a copyrighted rom to circumvent anti-piracy measures. the fb+ ships blank and violates no ebay rule on its own.
this doesn’t mean that it won’t get reported and that ebay won’t pull the auction without digging for the facts. i haven’t read the updated policy before today, i am fairly certain that you will lose all auction fees if the auction gets pulled for a violation. you can fight it, but you would need to be really informed of their policy.
if someone else can show proof that they specifically list flash kits or non-copyrighted video game development tools in their policy, please do so. i would hate to be giving incorrect advice.

My only input is that I have seen a Flashboy for sale on eBay. I don’t think they have a problem with it
Make sure you put in the ad that no copyrighted material will be in included.

Maybe I had listed it wrong, but I’d got an e-mail some 10 minutes later explaining I was in violation of ebays seller terms and conditions, I mean its a shame but I’m not too bothered I shouldn’t have too much trouble selling it, before I got one I was looking for these almost daily for a good long while, they really are fantastic bits of kit – but I’ve had my time with it and I know there are other loony virtual boy collectors like myself who wouldn’t mind giving those home brew games a bash π

It’s a flash boy plus I actually managed to acquire one after reading a post on this very site from 2-3 years prior where someone suggested e-mailing its inventor directly which I did and managed to get lucky! he’d just finished another small run so I picked one up – it’s a loose cart and cable in a baggy which kind of broke my heart when I got it but I was just so happy to finally have one I didn’t really question the lack of the proper virtual boy box, I figured he was simply trying to keep production costs down for this run.

They don’t come with a box, you have to buy them seperately
